The case, In re: Fidelity Investments Data Breach Litigation, Case No. 1:24-CV-12601-LTS, is pending in the U.S. District Court for the District of Massachusetts. It relates to a data security incident that occurred between August 17 and August 19, 2024, when an unauthorized third party accessed and obtained certain personal information on Fidelity’s computer network.
According to court filings, the information exposed varied by individual and may have included names, Social Security numbers, financial account information (including account and routing numbers), and driver’s license information. Fidelity (FMR LLC d/b/a Fidelity Investments and Fidelity Brokerage Services LLC) denies wrongdoing and is settling to avoid the cost and risk of continued litigation.
What you can claim
Fidelity has agreed to establish a $2.5 million settlement fund. After court-approved fees, service awards, and administration costs, the remaining money funds these benefits:
- Pro rata cash payment — about $100, no proof required. Every class member can claim this. The final amount may be higher or lower depending on how many valid claims are filed. California residents may receive an additional $50 under the California Consumer Privacy Act (CCPA).
- Reimbursement of documented losses — up to $5,000. For actual, documented out-of-pocket losses tied to the breach and incurred between August 17, 2024 and July 27, 2026 (and not already reimbursed elsewhere).
- Two years of free credit monitoring with three-bureau coverage and up to $1 million in identity theft insurance.
Where joint accountholders shared a single compromised account and routing number, only one claim is permitted.
Who is eligible
You may be a settlement class member if you reside in the United States and your account number and routing number were exposed in the August 2024 incident — including anyone Fidelity notified of the breach. Excluded are the presiding judge and court staff, Fidelity’s officers and directors, and anyone who validly opts out.
