People who were notified that their private information was affected in Modernizing Medicine's July 2025 data incident may qualify for benefits from a proposed $2,999,750 class action settlement.
The case is Cavallaro-Kearins v. Modernizing Medicine, Inc., No. 9:25-cv-81443-EA, in the U.S. District Court for the Southern District of Florida. Modernizing Medicine, also known as ModMed, denies wrongdoing. The court has not decided which side is right.
Claims must be submitted online or postmarked by November 2, 2026.
Who may qualify?
The court-authorized settlement website defines the class as all living people residing in the United States who were sent notice that their private information was affected in the Modernizing Medicine data incident.
The notice says the July 2025 incident involved a targeted cyberattack on two ModMed servers used to help convert limited data from retiring electronic health record platforms to ModMed's current platform. Files accessed in the incident may have included information such as:
- names, addresses, dates of birth, phone numbers, and email addresses;
- Social Security numbers;
- health insurance information; and
- medical information, including medical record or patient account numbers, dates of service, provider and practice names, billing or diagnostic codes, prescription or medication information, and diagnosis or treatment information.
Receiving an incident notice is central to the class definition, but it does not guarantee that a claim will be approved.
What benefits are available?
The settlement creates a $2,999,750 fund. After court-approved fees, costs, administration expenses, and any other approved deductions, the net fund will pay eligible benefits.
Two years of medical data monitoring
All class members may elect two years of CyEx Medical Shield Complete. The official FAQs say the service includes medical identity monitoring, one-bureau credit monitoring, dark-web scanning, security-freeze assistance, fraud-resolution support, and $1 million in medical identity theft insurance with no deductible, subject to the service terms.
Up to $5,000 for documented losses
Class members may claim reimbursement of up to $5,000 for actual, documented out-of-pocket losses related to the incident. Eligible losses must have occurred between July 9, 2025 and November 2, 2026.
The official FAQs list examples including identity-theft or fraud losses, credit-report or monitoring fees, credit-freeze costs, replacement identification costs, and postage. Claims require reasonable third-party documentation, such as receipts, correspondence, or account records. A personal statement by itself is not sufficient documentation.
Class members cannot receive reimbursement twice for the same expense from the settlement and another source.
Estimated $75 alternate cash payment
Instead of documented-loss reimbursement, class members may request a one-time alternate cash payment currently estimated at $75. No supporting proof is required for this option, but the final amount may be higher or lower depending on the number and value of approved claims and the net settlement fund.
A class member cannot receive both the documented-loss payment and the alternate cash payment. Medical data monitoring may be selected in addition to either cash option.
How to file a claim
Claims can be filed through the official Modernizing Medicine Data Settlement website. The online form asks for the LoginID and PIN included with the notice. A printable form is also available for mailing to the settlement administrator.
Online claims must be submitted by November 2, 2026. Mailed claims must be completed, signed, include any required supporting documentation, and be postmarked by the same date. Filing is free.
The deadline to opt out or object is October 19, 2026. Opting out and objecting have different legal effects; class members considering either should read the official notice carefully.
When will payments be issued?
The final approval hearing is scheduled for November 17, 2026 at 2:30 p.m. Eastern in West Palm Beach, Florida. The date may change, so class members should check the official website.
Benefits will be issued only if the court grants final approval and any appeals are resolved. Submitting a claim does not guarantee payment or a particular amount.
