Overview

A settlement has been reached in McCulley, et al. v. Banner Health (Case No. 2026CV30182, District Court for Weld County, Colorado). The lawsuit alleges that Banner Health disclosed patients' personally identifiable information (PII) and protected health information (PHI) to third parties — including Meta (Facebook) and Google — through tracking technologies installed on Banner's website and webpages, resulting in an alleged invasion of privacy. Banner denies all allegations of liability and wrongdoing.

Who qualifies

• You had a Banner Health Patient Account (formerly the MyBanner patient portal).
• You logged in to that account using one of Banner's web properties or applications between June 1, 2020 and November 22, 2023.

What you could receive

Each settlement class member automatically receives a code to enroll in one (1) year of CyEx Privacy Shield Pro. Class members may also submit a claim form to receive a $20 cash Settlement Payment. Submitting a claim form is the only way to receive the cash payment.
