Court and case
Cole County Circuit Court, Missouri, No. 22AC-CC07646

Boone Health operates a health care system in Missouri, and patients use its online portal to access health information and services. A class action alleges that third-party technologies on Boone Health's public website transmitted certain information to outside parties without authorization. Boone Health denies wrongdoing. The Cole County, Missouri court has allowed notice of a proposed settlement but has not yet decided whether to give it final approval. The settlement class generally covers Boone Health patients residing in Missouri who logged into its Patient Portal from April 1, 2021 through December 5, 2022 and appear on the Settlement Class List. An approved cash claim pays $20. Class members can also enroll in one year of CyEx Privacy Shield using separate activation instructions. These benefits can be combined. A portal login alone does not establish that any particular patient's information was transmitted. File a cash claim online or by mail by November 9, 2026. A Privacy Shield code is sent separately and must be activated within 90 days of receipt under the amended agreement. Exclusion requests are due October 9, 2026; objections are due November 9, 2026. The final approval hearing is set for December 1, 2026. The official administrator site and notice control the filing instructions.

Who qualifies

  • Patient and residence: You are or were a Boone Health patient and reside in Missouri. Being a patient somewhere else does not meet this class definition.
  • Portal and dates: You logged into the Boone Health Patient Portal between April 1, 2021 and December 5, 2022. The criterion is a portal login, not merely visiting the public website or receiving treatment during that period.
  • Administrator match: The amended agreement defines the class by reference to its Settlement Class List. Cash claimants must provide enough information for the administrator to match them, including a valid email address, and attest that they are eligible. The notice directs people without their emailed or mailed login credentials to contact the administrator for verification.
  • Exclusions: The judge reviewing the settlement, court personnel, and their immediate families are excluded, as are Boone Health and specified related entities and representatives. Review the full class definition in the notice and agreement if one of those exclusions could apply.

What you could receive

Cash claim

$20 for an approved claim

Submit a timely, valid claim form through the official settlement site or by mail. The administrator must match the claimant to the class list and verify the eligibility attestation. One cash payment is available per unique class member. The claim deadline is November 9, 2026; payment follows the settlement's effective date and claim approval.

Separate activation

One year of CyEx Privacy Shield

The amended agreement provides a one-year subscription, with a link, code, and activation instructions sent separately to class members. Enrollment requires activating the code within 90 days after receipt. A cash claim is not required to use this separate benefit, and an eligible member may use both. The agreement lists VPN, password, data-broker opt-out, private-search, and digital-vault features.

A Settlement Class Member may submit a valid claim for one $20 cash payment and separately activate a one-year CyEx Privacy Shield subscription. The two benefits can be combined. A cash claim requires the administrator to match the claimant to the Settlement Class List and requires an eligibility attestation; no proof of financial loss is specified. The administrator sends Privacy Shield activation instructions separately. The agreement gives class members 90 days from receipt of an activation code to enroll. Payment depends on final approval and the settlement becoming effective.

How to file your claim

  1. Check the official Boone Health Settlement site and your notice to confirm the class criteria, your options, and the administrator's current instructions.
  2. For $20, submit the official online claim form by 11:59 p.m. PST on November 9, 2026, or mail a paper form postmarked by that date. Use the class-member login ID and password in your notice; if you lack them, contact boonehealthsettlement@atticusadmin.com to verify your identity, as the notice directs.
  3. For Privacy Shield, follow the separate email with the enrollment link and activation code. The amended agreement allows 90 days from receiving the code to enroll. You can also submit a cash claim.
  4. To exclude yourself instead, follow the written-request instructions in the official notice and mail or deliver your request by October 9, 2026. Excluding yourself means you receive neither benefit.

Frequently asked questions

Does a Boone Health appointment alone make me eligible?

No. The published class definition also requires Missouri residence and a Boone Health Patient Portal login during April 1, 2021 through December 5, 2022. The administrator checks claims against the Settlement Class List.

Do I have to choose between $20 and Privacy Shield?

No. The notice says class members may enroll in Privacy Shield as well as file a claim for $20. The cash payment needs an approved claim; Privacy Shield has separate code-activation instructions.

What if I never received a notice or login ID?

The official notice tells people who believe they are class members but lack credentials to email boonehealthsettlement@atticusadmin.com for identity verification and a class-member login ID and password. Contacting the administrator does not guarantee eligibility.

Was it decided that Boone Health disclosed my information?

No. The lawsuit alleges unauthorized transmission through third-party website technology, and Boone Health denies the allegations. The settlement and preliminary approval do not establish what happened to any one person's information or decide liability.

What happens if I do nothing?

Under the notice, you will not receive settlement benefits. If the settlement becomes final and you did not exclude yourself, you will still release the claims covered by it, even without submitting a claim.

Is Class Action Pulse handling my claim?

No. Class Action Pulse is not the settlement administrator or a law firm. Use the official Boone Health Settlement site and its administrator for claims, activation, and questions. Eligibility and payment are not guaranteed.
