Brevard Skin & Cancer Center is the operating name of DRS Roberts & Bryan PA, a Florida dermatology practice. Patients use the practice for skin care and may provide identity, contact, insurance, billing, and clinical information. The settlement concerns files accessed during a targeted cyberattack on the practice's systems in September 2025.
Plaintiffs Patti Myers, Lona Rogers, Linda Cox, and Judy Shapow filed claims on behalf of people with similar notices. They alleged that Brevard Skin & Cancer Center failed to protect private information. The practice denies wrongdoing, and the Circuit Court for Brevard County, Florida has not decided which side is right. The court preliminarily approved a settlement in case No. 05-2025-CA-054649-XXCA-BC.
The settlement covers living U.S. residents sent notice that their private information may have been affected. Possible information listed in the notice includes names, birth dates, addresses, billing and claims information, Social Security numbers, diagnosis and clinical information, phone numbers, email addresses, and health conditions included in Family and Medical Leave Act forms.
Class members may choose a $45 cash payment without loss documentation or claim up to $2,500 for documented out-of-pocket losses tied to the incident. They cannot receive both cash options. All class members are also eligible for one year of CyEx Medical Shield Complete medical-data monitoring with up to $1 million in medical identity-theft insurance. Cash claims are due November 16, 2026; monitoring enrollment uses the code sent by postcard.

- You are not an excluded director, officer, or agent of the defendant; a governmental entity; the assigned judge, immediate family, or court staff; or a person who validly opted out.
- You submit a valid cash claim by November 16, 2026 or follow the separate monitoring activation instructions sent to class members.

One year of medical-data monitoring

Class members may select one of two cash benefits. Cash Payment A reimburses actual, documented out-of-pocket losses due to the incident, up to $2,500. Eligible expenses described in the notice include certain fraud or identity-theft losses and reasonable costs for credit reports, monitoring, freezes, identity-document replacement, and contacting financial institutions.
Cash Payment B is a $45 payment instead of documented-loss reimbursement. It does not require proof of a loss. A claimant cannot receive both Cash Payment A and Cash Payment B.
All class members are also eligible for one year of CyEx Medical Shield Complete. The official notice says the service includes monitoring for healthcare-insurance identifier exposure, medical-record-number exposure, and unauthorized Health Savings Account spending, plus up to $1 million in medical identity-theft insurance and access to fraud-resolution assistance. The administrator sent activation codes by postcard; contact it if your code is missing.

Can I receive both the $45 payment and documented losses?
No. The official notice presents the two cash payments as alternatives. You may select either $45 without loss proof or documented losses up to $2,500. Medical monitoring is available in addition to the selected cash option.
What proof is required for the $2,500 benefit?
You must provide reasonable documentation of an actual out-of-pocket loss and show that it was due to the data incident. The administrator reviews the claim. The $45 alternative cash option does not require loss documentation.
Is there a settlement fund total?
The reviewed official notice describes benefits paid per valid claim but does not state an aggregate common fund. Do not infer a total from the maximum individual benefits.
What happens if I do nothing?
You receive no cash benefit. Unless you validly opted out, you remain bound by the settlement and release if the court grants final approval. The monitoring benefit also requires activation with the code provided to class members.
