Broward County Circuit Court, No. CACE-26-011830
CPAP Medical Supplies and Services, Inc. agreed to a proposed settlement in Brett Conner v. CPAP Medical Supplies and Services, Inc., Case No. CACE-26-011830, pending in the Circuit Court for Broward County, Florida. CPAP provides sleep-apnea equipment and related services, including services used by active-duty and retired military members. Its records can contain contact, insurance, treatment, and payment data.
The case concerns unauthorized access to CPAP's systems from December 13 through December 21, 2024. CPAP says it discovered after investigation and document review that affected files contained identifiable protected health and personal information. The lawsuit alleges that CPAP failed to protect that information. CPAP denies wrongdoing, and the court has not decided which side is right.
An approved claimant may request up to $5,000 for documented, unreimbursed losses incurred from December 13, 2024 through November 26, 2026 and caused by the incident. All class members may also request two years of CyEx Medical Shield Complete, including medical-data monitoring and $1 million in medical identity-theft insurance under the service terms. The total documented-loss benefit is capped at $500,000, so approved payments may be reduced proportionally. Claims are due November 26, 2026.
Who qualifies
Residence and status: You are a living person residing in the United States.
Notice requirement: CPAP sent you notice stating that your private information may have been impacted in the December 2024 data incident.
Record-based class: CPAP's records identify the class. Contact the administrator if you received an incident notice but are unsure about the settlement notice or claim credentials.
Exclusions: CPAP's directors, officers, and agents; government entities; the assigned judge and certain related people; valid opt-outs; and other excluded groups do not qualify.
What you could receive
Documented benefit
Up to $5,000 for incident-related losses
Requires records such as receipts or bank statements showing the amount and link to the incident. Covered examples include qualifying fraud losses, monitoring or credit-freeze fees, replacement identification, and postage. No double reimbursement.
Protection benefit
Two years of medical data monitoring
CyEx Medical Shield Complete monitors specified medical identifiers and includes medical identity-theft insurance and fraud-resolution assistance under its terms. It may be claimed together with an approved documented-loss payment.
A class member may claim up to $5,000 for actual, documented, unreimbursed losses caused by the incident and incurred from December 13, 2024 through November 26, 2026. The aggregate amount available for documented losses is $500,000. If approved claims exceed that cap, individual distributions are reduced pro rata. All class members may also request two years of CyEx Medical Shield Complete, which includes monitoring for medical identifiers and $1 million of medical identity-theft insurance under the provider's terms. The monitoring benefit and documented-loss payment can be combined.
How to file your claim
Locate the settlement notice and review the official website to confirm that CPAP's records identify you as a class member.
Elect the medical data monitoring benefit if you want it. The claim form also allows a documented-loss request.
Gather third-party proof for any loss request. Show the amount, date, and connection to the incident. Self-prepared notes alone are not enough.
Do not seek payment for costs already reimbursed by insurance, CPAP, a bank, or another source.
Submit the official claim online or mail a completed, signed form postmarked by November 26, 2026. Keep a copy and confirmation.

CPAP provides equipment and support used to treat sleep apnea, including continuous positive airway pressure equipment. The affected records may relate to patients, employees, insurance, treatment, and payment administration.
Has the court found CPAP responsible?
No. The plaintiffs allege inadequate protection of private information. CPAP denies wrongdoing, and preliminary approval is not a ruling on liability.
Is there a no-proof cash option?
The court-authorized notice describes documented-loss reimbursement and medical data monitoring. It does not describe a separate alternative cash payment.
Can I combine the two listed benefits?
Yes. The notice says all class members may claim monitoring and may also request documented losses if they have qualifying proof.
Is the full $5,000 guaranteed?
No. Payment depends on approved documentation and causation. The benefit also has a $500,000 aggregate cap, so proportional reductions may apply.
Is Class Action Pulse the settlement administrator?
No. Class Action Pulse is not a law firm or settlement administrator and cannot guarantee eligibility or payment. Use the official settlement website.
