CUSO Financial Services, L.P. agreed to a proposed $1.75 million settlement in Stan Sinitsa v. CUSO Financial Services, L.P., Case No. VCU326251, pending in the California Superior Court for Tulare County. CUSO provides brokerage and investment services through financial institutions such as credit unions. That role can place customer identification and account-related information in systems used by CUSO or its service providers.
The case concerns unauthorized access to one CUSO employee's account on a third-party communications-archiving service from December 19, 2023 through January 19, 2024. CUSO says it learned of the incident on January 19, investigated, and sent notices around October 2024 to people whose information may have been compromised. The named plaintiff alleges CUSO was negligent. CUSO denies negligence, fault, wrongdoing, and liability and says it would have prevailed. The court has not decided the merits.
A class member with an approved claim may request up to $5,000 for documented, unreimbursed losses fairly traceable to the incident. California subclass members may also request up to $100 with proof of California residence on December 19, 2023. All class members may request a residual cash payment of up to $599, subject to the money remaining in the net fund and pro rata reduction. Two years of IDX three-bureau credit monitoring may also be requested. The official claim form permits these benefits to be combined under its rules, but documented expenses cannot be reimbursed twice.
Claims must be submitted online or postmarked by November 16, 2026. The deadline to exclude yourself or object is October 1, 2026. The final approval hearing is scheduled for February 18, 2027 at 8:30 a.m. Payments depend on final approval, claim review, and any appeals. Doing nothing provides no benefit and, unless a person validly opts out, releases covered claims if the settlement becomes final.
Who qualifies
Incident connection: You are a U.S. resident whose private information was stored in an affected CUSO account and impacted by the incident from December 19, 2023 through January 19, 2024.
Notice requirement: You received a CUSO notice around October 2024 stating that your information may have been compromised. The Claim Number and PIN on the notice are required by the official claim form.
California subclass: You may request the additional California statutory payment only if you were a California resident on December 19, 2023 and provide proof.
Exclusions: CUSO and its officers and directors, the assigned judge and the judge's staff and family, valid opt-outs, and anyone criminally responsible for the incident are excluded under the notice.
What you could receive
Documented benefit
Up to $5,000 for incident-related losses
Requires third-party records for reasonable, unreimbursed expenses fairly traceable to the incident, including qualifying fraud, tax, monitoring, credit-freeze, or response costs incurred on or after December 19, 2023.
California benefit
Up to $100 statutory cash payment
Available only to California subclass members. Proof of California residence on December 19, 2023, such as a utility bill, tax record, or pay stub, is required.
Residual benefit
Up to $599 residual cash payment
May be requested in addition to other benefits. The amount depends on funds left after higher-priority payments and costs, so it may be reduced pro rata below $599.
Protection benefit
Two years of three-bureau monitoring
IDX monitoring includes alerts, dark-web monitoring, identity restoration, lost-wallet help, advisory support, and $1 million in reimbursement insurance under the service terms.
The $1.75 million non-reversionary fund pays approved claims, administration, taxes, court-approved attorneys' fees and costs, and any service award. Approved documented losses receive priority, followed by California statutory payments and residual cash. A claimant may request up to $5,000 for supported, unreimbursed expenses fairly traceable to the incident. California subclass members may request up to $100 with residence proof. Every approved claimant may elect residual cash of up to $599 if funds remain, but the final amount may be lower. Two years of IDX three-bureau credit monitoring is separately available. If approved claims exceed the net fund, monetary benefits are reduced pro rata according to the official order of payment.
How to file your claim
Find the October 2024 CUSO incident notice and the Claim Number and PIN printed on it. Contact the official administrator if you are unsure whether records identify you as a class member.
Decide which benefits fit your circumstances. The official form permits monitoring, documented losses, an eligible California payment, and residual cash to be elected under the settlement rules.
Gather third-party records for documented losses. Self-prepared records alone are not enough, and expenses already reimbursed by another source cannot be claimed again.
If requesting the California payment, include proof that you lived in California on December 19, 2023.
Submit the official form online at CUSOCybersecurityIncident.com or mail a signed form and supporting records postmarked by November 16, 2026. Keep a copy and confirmation.

Do you qualify?

CUSO Financial Services has provided brokerage and investment services through banks and credit unions. The incident involved an employee account on a third-party service used to archive communications for financial-industry compliance.
Has the court found CUSO responsible?
No. The plaintiff alleges negligence, but CUSO denies wrongdoing and liability. Preliminary approval allows notice and claims; it is not a ruling on the merits.
Can the benefits be combined?
The claim form allows a class member to request monitoring, documented losses, and residual cash. An eligible California subclass member may also request the California payment. Each benefit remains subject to its own proof and fund-allocation rules.
Is the $599 payment guaranteed?
No. It is a residual payment made only from funds remaining after higher-priority benefits and costs. The final amount may be lower because it is calculated pro rata.
What happens if I do nothing?
You receive no payment or monitoring. Unless you validly excluded yourself by October 1, 2026, you will be bound by the release if the settlement becomes final.
When will payments be issued?
No fixed payment date is available. The court will consider final approval on February 18, 2027, and distribution can occur only after approval, appeals, and claim review.
Does Class Action Pulse guarantee my claim?
No. Class Action Pulse is not a law firm or settlement administrator and does not guarantee eligibility or payment. Use only the official settlement materials.
