Overview

EMM Loans, LLC agreed to settle a class action lawsuit over a targeted cyberattack on its computer systems discovered in February 2024. Files accessed in the incident may have contained names, Social Security numbers, driver's license or other state identification numbers, and passport numbers. EMM Loans denies wrongdoing, and the court has not decided who is right. The case is Lehrbach v. EMM Loans, LLC, Case No. 1:25-cv-02040, in the U.S. District Court for the District of New Jersey.

Settlement class members may claim up to $4,000 for unreimbursed economic losses tied to the data incident, including documented out-of-pocket losses and up to three hours of lost time at $30 per hour. Instead, class members may choose a $50 alternative cash payment without proof. Class members may also enroll in two years of CyEx Financial Shield Complete with up to $1 million in financial fraud insurance.
