Overview

A $2,150,000 settlement has been reached in Sharber, et al. v. FMC Services, LLC (No. 111219-D-CV, District Court of Potter County, Texas, 320th Judicial District), arising out of a data incident that occurred on or about July 26, 2022. Plaintiffs allege that unauthorized third parties accessed FMC's computer systems and compromised patients' private information — potentially including name, mailing address, date of birth, Social Security number, and medical information. FMC denies that any information was acquired and denies any wrongdoing.

Who qualifies

• Your personally identifiable or personal health information was compromised in the July 26, 2022 FMC Services data incident.
• You were sent a notice of the data incident by FMC Services.

What you could receive

Eligible class members who submit a valid claim may receive one of the following, subject to pro rata adjustment: Cash Payment A — up to $5,000 for reasonable documented out-of-pocket losses related to the incident; or Cash Payment B — an estimated $75 alternate cash payment with no documentation required. In addition, class members may claim two years of CyEx medical data monitoring, which includes credit-file monitoring, dark web scanning, and up to $1,000,000 in identity-theft insurance with no deductible.
