Overview

A nationwide settlement has been preliminarily approved in Tuccori, et al. v. At World Properties LLC, et al., No. 1:24-cv-00150, in the U.S. District Court for the Northern District of Illinois. The lawsuit alleges that real estate brokerages, franchisors, and other companies conspired to raise, fix, maintain, or stabilize broker commissions in violation of federal and state law. The settling defendants deny wrongdoing, and the court has not decided who is right.

Who qualifies

  • You purchased a home that was listed on a multiple listing service in the United States.
  • A commission was paid to a brokerage in connection with that home purchase.
  • Your purchase occurred during the class period that applies to the state or territory where the home was located; the start date varies by location and defendant.
  • You are not covered only as a home seller by a separate seller settlement, and you did not validly exclude yourself from this settlement.

What you could receive

Valid claimants may receive a pro rata cash payment from the $120,334,500 global settlement fund. The administrator will consider qualifying properties, commissions paid, and the number of valid claims when calculating payments. Exact individual amounts are not yet known, and distributions may occur in installments after final approval and any appeals.

How to file your claim
