Overview

The proposed settlement resolves claims that Kroger should have considered prices available through its Savings Club when reporting usual and customary prescription prices for insured purchases. Kroger denies wrongdoing. The net settlement fund will be distributed to class members who submit valid claims, with each payment based on the claimant's eligible prescription spending and the total value of approved claims.

Who qualifies

  • You lived in the United States or one of its territories during the settlement class period.
  • You paid all or part of the cost of one or more prescription drugs at a pharmacy owned or operated by Kroger or one of its affiliates.
  • You used prescription insurance benefits for the qualifying purchase.
  • The purchase occurred between December 9, 2018 and August 23, 2026.

What you could receive

Kroger will pay $17 million into the settlement fund. After court-approved fees, expenses, notice and administration costs, service awards, and other deductions, the remaining fund will be distributed pro rata. Individual payments depend on the amount each approved claimant paid for eligible prescriptions and the total value of all approved claims. Claims totaling $8,000 or more require supporting documentation. The administrator may also request records for smaller claims it cannot match to Kroger purchase data.

How to file your claim

  1. 1Review the official notice and confirm that your insured Kroger prescription purchases fall within the settlement class period.
  2. 2Submit the official claim form online, or download and mail a completed paper form.
  3. 3Estimate or document the amount you paid for qualifying prescriptions; provide supporting records if your claimed total is $8,000 or more or if the administrator requests them.
  4. 4Submit the claim online or ensure a mailed claim is received as directed by December 21, 2026.
