$40 without a claim
Non-excluded class members will receive a check at their last known mailing address after the settlement becomes final, unless they elect a supported digital payment through the official payment form.

Olinsky & Associates, PLLC agreed to settle a lawsuit over a cybersecurity incident it discovered on or about January 28, 2025. Plaintiff Felipe Leon-Roman alleged failures to protect private information and brought claims for negligence, breach of implied contract, and unjust enrichment. Olinsky denies wrongdoing, and the U.S. District Court for the Northern District of New York has not decided who is right. The case is Leon-Roman v. Olinsky & Associates, PLLC, No. 5:25-cv-00462-ECC-CBF. The court preliminarily approved the proposed settlement and conditionally certified a class of people Olinsky identified as impacted, including those sent notice. The settlement agreement reports approximately 526 potentially impacted people; the preliminary approval order cites approximately 521 class members. Those figures come from different stages of the record, not from a final court finding about the number of eligible recipients. Non-excluded class members need not submit a claim. If the settlement becomes final, each is due a $40 payment and an enrollment code for three years of CyEx Financial Shield Complete. The rights deadline of October 26, 2026 applies to opting out or objecting, not to claiming benefits. The final approval hearing is scheduled for December 2, 2026; payments depend on approval and resolution of any appeals.
Non-excluded class members will receive a check at their last known mailing address after the settlement becomes final, unless they elect a supported digital payment through the official payment form.
Enrollment codes were sent with the settlement postcard. The official FAQ says the service includes one-bureau credit monitoring, financial transaction and account monitoring, real-time authentication alerts, identity-theft insurance, and access to a fraud resolution agent. Use the code to enroll; coverage becomes active only after final approval and any appeals.
The official Address Update and Payment Election form permits an address update or payment by Zelle, PayPal, Venmo, Mastercard, or ACH. This is not a claim form and is not required to receive the default check.
Every settlement class member who does not opt out is entitled to a $40 cash payment and an enrollment code for three years of CyEx Financial Shield Complete, subject to the settlement becoming final. The default payment is a check sent to the last known mailing address. The official site offers an optional form to update contact information or choose a digital payment. An enrollment code is sent automatically, but the monitoring service must be enrolled in with that code and becomes active only after final approval and any appeals. This settlement does not offer a separate documented-loss claim or require a claim form.
