Overview

The proposed settlement would resolve allegations that the SpeedControl Dial for the SmartDrive MX2+ Power Assist Device was defective and did not function as intended. The case is Garofalo v. Permobil, Inc., No. 2:25-cv-2080, in the U.S. District Court for the Eastern District of Louisiana. Permobil and Max Mobility deny wrongdoing, and the court has not decided which side is right.

What you could receive

The settlement creates a $4.1 million cash fund. Authorized claimants may request reimbursement for verifiable out-of-pocket expenses to repair or replace the SpeedControl Dial, up to $1,000 per claim and subject to a $100,000 aggregate cap. After those reimbursements and court-approved deductions, the remaining net fund will be distributed pro rata to authorized cash-benefit claimants. No fixed cash payment is guaranteed.
