W.D. Kentucky, No. 3:25-cv-563

Southern Graphics, a brand and marketing production company also known as SGS & Co., agreed to a $750,000 settlement over allegations arising from unauthorized access to its computer systems in December 2024. The proposed class covers living people in the United States whose private information was potentially compromised, including people mailed an incident notice. Southern Graphics denies wrongdoing, and the court has not decided that the company violated the law. A valid claim must be filed online or postmarked by November 3, 2026. Class members may choose either reimbursement of up to $3,500 for supported losses or a pro rata cash payment that does not require proof. They may also request two years of one-bureau credit and identity-theft monitoring. The documented-loss and alternate-cash options cannot be combined, but either cash option may be combined with credit monitoring. The U.S. District Court for the Western District of Kentucky granted preliminary approval on August 17, 2026. Final approval is not guaranteed. Payments and credit monitoring will be distributed only after final approval and resolution of any appeals. Class members who do nothing receive no benefit and, unless they opt out, give up covered claims relating to the incident.

Who qualifies

  • Incident connection: You are a living person in the United States whose private information was potentially compromised in the December 2024 Southern Graphics data incident. People mailed an incident notice are included in the class definition.
  • Information involved: The covered records may include names, contact details, dates of birth, Social Security or tax identification numbers, driver's license or state ID numbers, passport numbers, financial information, health information, health-insurance information, or other personally identifiable information.
  • Exclusions: Southern Graphics directors and officers, its subsidiaries and affiliated companies, government entities, the judges assigned to the case, their immediate families, and court staff are excluded.
  • Record and notice check: Southern Graphics supplied the administrator with the class list. If you are unsure whether you are included, contact the official settlement administrator rather than assuming that any connection to the company establishes eligibility.

What you could receive

Option A

Up to $3,500 for documented losses

Submit reasonable third-party or contemporaneous records for losses fairly connected to the incident, such as receipts, correspondence, or account records. Self-prepared statements may explain other proof but are not enough by themselves. Previously reimbursed expenses cannot be claimed again.

Option B

Pro rata cash with no proof

Choose this instead of documented-loss reimbursement. The amount depends on the net fund and valid claims, so the settlement does not promise a fixed payment.

Additional benefit

Two years of credit monitoring

Eligible class members may request CyEx Financial Shield Complete in addition to either cash option. The service includes one-bureau monitoring and financial fraud insurance under the provider's terms.

A class member may select Cash Payment A for up to $3,500 in actual, documented out-of-pocket losses caused by the incident between December 2, 2024 and November 3, 2026, or Cash Payment B, a pro rata cash payment with no proof requirement. The two cash choices cannot be combined. Either cash choice may be combined with two years of CyEx Financial Shield Complete one-bureau monitoring. The $750,000 fund also pays administration, approved attorneys' fees and costs, service awards, monitoring claims, and documented-loss claims. Alternate cash therefore has no guaranteed amount and may increase or decrease under the distribution rules.

Frequently asked questions

How much is the automatic cash payment?

There is no fixed automatic payment. The alternate cash benefit is pro rata, meaning the available net fund is divided under the settlement's distribution rules among valid claims. The final amount is not yet known.

Can I claim $3,500 and the pro rata cash payment?

No. A claimant must choose documented-loss reimbursement or alternate cash. Credit monitoring may be requested with either cash choice.

What proof is required for documented losses?

The notice calls for reasonable documentation such as receipts, correspondence, or other records supporting the loss. A personal declaration alone is not enough, though it may help explain other submitted records.

What happens if I do nothing?

You receive no payment or monitoring. Unless you validly opt out by October 19, 2026, you remain bound by the settlement and its release if final approval occurs.

Has Southern Graphics admitted liability?

No. Southern Graphics denies the allegations and wrongdoing. Preliminary approval permits notice and claims administration; it is not a finding that the allegations are true.

Is Class Action Pulse administering this settlement?

No. Class Action Pulse is not a law firm or settlement administrator and cannot guarantee eligibility or payment. Use the official settlement website for claims.
