People in the class can claim a one-time $16 cash payment with no proof required, and can also get two years of a privacy protection service called CyEx Privacy Shield Pro. Claims are due March 15, 2027.

The case is Jane Doe v. AMISUB (SFH), Inc. d/b/a Saint Francis Hospital-Memphis, Case No. CT-3086-23, in the Circuit Court for Shelby County, Tennessee. The court authorized notice, and the settlement administrator began mailing notices on October 22, 2026. The court has not yet granted final approval, and no money will be paid unless it does. Tenet denies wrongdoing.

Who the parties are

The defendant is Tenet Healthcare Corporation, which signed the settlement on behalf of itself and its affiliated covered entities. The named defendant in the case caption, AMISUB (SFH), Inc., does business as Saint Francis Hospital-Memphis. Tenet's lawyer listed in the notice is Scott A. Elder of Alston & Bird LLP in Atlanta.

The plaintiffs are 28 class representatives named in the court-authorized notice, The case caption uses the name Jane Doe. The court appointed J. Gerard Stranch IV of Stranch, Jennings & Garvey, PLLC in Nashville as class counsel.

Simpluris is the settlement administrator. It runs the official site, TenetPixelSettlement.com, and processes claims.

What happened

The lawsuit says Tenet used third-party tracking technologies, often called tracking pixels, on its web pages in a way that violated certain privacy laws. A tracking pixel is a small piece of code that can send information about what a visitor does on a page to an outside company. The settlement notice does not name the outside companies or list the specific data involved.

  • January 1, 2017, through September 18, 2023: the class period covered by the settlement.
  • July 30, 2026: Tenet and class counsel signed the settlement agreement.
  • October 22, 2026: notice mailing began, according to the settlement website.
  • December 21, 2026: deadline to opt out or object.
  • January 14, 2027: final approval hearing.
  • March 15, 2027: claim deadline.

Some secondary sites listed an earlier opt-out deadline of November 27, 2026. The official notice and settlement website now give December 21, 2026.

What each side says

The plaintiffs say Tenet's use of tracking pixels on its websites and patient portals violated privacy laws. They and their lawyer say the settlement is best for the class.

Tenet "denies that it did anything wrong," according to the notice. Both sides agreed to settle to avoid the costs, risks and uncertainty of continued litigation. The court has not decided who is right.

What the court has and has not decided

The Shelby County Circuit Court authorized the notice and set the deadlines and hearing date. It has not granted final approval. At the January 14, 2027 hearing, the court will decide whether the settlement is fair, how much class counsel should be paid and whether to approve service awards.

The court has not found that Tenet broke any law. The hearing date and time may change without further notice, so check the official site before attending.

Who may qualify

  • Platforms: You used a Tenet website, patient portal, the Healthelife app or other Tenet web tool.
  • Actions: You created a portal account, submitted a web form, or checked in to urgent care or an ER online.
  • Dates: You did so between January 1, 2017, and September 18, 2023.
  • Records: Tenet's records identify you. Many class members received a notice or postcard.

The court defined the class as "All Identifiable Individuals that used or accessed the Online Platforms during the Class Period." In plain terms, you are in the class if, between January 1, 2017, and September 18, 2023, you used a website or patient portal owned or operated by Tenet or a current or former Tenet affiliate to do at least one of these things:

  • create a patient portal account;
  • submit a web form; or
  • check in to an urgent care or emergency room online.

The online platforms include Tenet websites, patient portals, the Healthelife app and other web-based tools Tenet operated. Class members are identified through Tenet's records, and many received a notice by mail. The class excludes the judge and the judge's family and staff, Tenet and its officers, directors and related companies, the parties' lawyers, and anyone who opts out.

What you could receive

Cash

$16 payment

One-time payment for a valid claim. No proof or explanation required.

Service

CyEx Privacy Shield Pro

Two years of dark web and password scanning, a VPN, a password manager and fraud resolution help. Use the code from your postcard after final approval.

Timing

Paid after approval

Benefits are issued only after final approval on or after January 14, 2027, and any appeals.

There are two benefits, and you can get one or both.

The cash payment is a one-time $16. You do not need to provide proof or an explanation. You must file a valid claim to receive it.

CyEx Privacy Shield Pro is a two-year privacy service with dark web scanning, compromised password scanning, a VPN, a password manager and access to fraud resolution agents. Enrollment codes were mailed to class members by postcard, and the postcard says enrollment instructions will be posted after final approval.

Tenet pays for these benefits. Class counsel will separately ask the court for up to $8,500,000 in attorneys' fees and costs and $3,500 for each class representative, also paid by Tenet. The notice does not describe a fixed settlement fund, so the $8.5 million figure is a fee request, not the amount available to class members. Payments go out only after final approval and any appeals.

Important dates and rights

  • December 21, 2026: deadline to opt out. Your written request must be submitted, postmarked or emailed by this date.
  • December 21, 2026: deadline to file an objection with the Clerk of Court, with copies to the administrator and the lawyers.
  • January 14, 2027, 10:00 a.m. Central: final approval hearing at 140 Adams Avenue, Room 324, Memphis, Tennessee.
  • March 15, 2027: claim deadline.

The notice says mailed claims must be postmarked by March 15, 2027, while the claim form says claims must be received by that date. To be safe, mail a paper claim well before the deadline or file online.

If you do nothing, you get no cash and you give up the right to sue Tenet over the claims this settlement resolves. If you opt out, you get nothing from the settlement but keep your right to sue on your own.

What happens next

The opt-out and objection deadline is December 21, 2026, and the court will hold the final approval hearing on January 14, 2027. If appeals are filed, payments could be delayed. Class Action Pulse will update this page after the hearing.

Sources and evidence boundaries

All settlement terms on this page come from the official settlement website, the court-authorized long-form notice, the claim form and the settlement agreement exhibits posted by the administrator. The notice does not say how many people are in the class, which tracking companies were involved or what specific data was shared, so this page does not estimate those. Some third-party summaries described the $8.5 million figure as the settlement amount. The official notice describes it as a request for attorneys' fees and costs.
