Vasindas’ Around the Clock Care, Inc. agreed to a proposed settlement in Nelson et al. v. Vasindas’ Around the Clock Care, Inc., Case No. BCV-24-102900, pending in Kern County Superior Court in California. Vasindas is a home-health agency. Patients, customers, and employees can provide the company with identity, medical, insurance, employment, and financial information through care or work. The case concerns a targeted cyberattack involving Vasindas' systems. The settlement notice identifies January 2024 as the incident period and says files containing private information were accessed. Potentially involved fields included names, addresses, Social Security numbers, and medical and health-insurance information. The plaintiffs allege inadequate protection. Vasindas denies all claims, wrongdoing, and liability, and the court has not found that it violated the law. An approved claimant may select either up to $2,500 for documented, unreimbursed incident-related losses or a $70 alternative cash payment without loss proof. Either cash choice may be combined with two years of CyEx Medical Shield Complete. Claims are due November 23, 2026. The opt-out and objection deadline is October 26, 2026, and the final approval hearing is scheduled for December 3, 2026.

Who qualifies

  • Status: You are a living citizen of the United States.
  • Notice requirement: You were sent notice that your personal information was actually or potentially accessed or compromised in the January 2024 incident.
  • Record-based identification: Vasindas' records identify class members. Contact the administrator if you received an incident notice but cannot find claim information.
  • Exclusions: The judge and certain related people, lawyers and certain related people, government entities, Vasindas and related personnel, valid opt-outs, and the person responsible for the incident are excluded under the notice.

What you could receive

Documented benefit

Up to $2,500 for incident-related losses

Requires records such as receipts or bank statements showing the amount and connection to the incident. Self-prepared notes may support other proof but are not enough alone. Expenses reimbursed elsewhere cannot be claimed again.

Alternative benefit

$70 cash without loss documentation

Available instead of the documented-loss payment. A claimant must still be in the class and submit a valid, timely claim.

Protection benefit

Two years of medical monitoring

CyEx Medical Shield Complete includes monitoring for specified medical identifiers, $1 million in medical identity-theft insurance, and fraud-resolution support under the service terms. It may be combined with either cash choice.

A claimant may select one cash option. The documented-loss benefit pays up to $2,500 for actual, supported, unreimbursed losses caused by the incident and incurred from January 30, 2024 through November 23, 2026. Instead, a claimant may request a one-time $70 alternative payment without documenting a loss. The notice says the alternative payment is instead of other cash payments. Either cash option may be combined with two years of CyEx Medical Shield Complete. Benefits issue only after final approval becomes effective and claim review is complete.

How to file your claim

  1. Review the notice you received and the official website to confirm that Vasindas' records identify you as a settlement class member.

  3. If requesting documented losses, gather third-party proof showing the expense, date, and connection to the incident. Do not include reimbursed costs.
