Overview
The proposed settlement concerns allegations that Xactus and Credit Plus failed to use reasonable procedures to assure maximum possible accuracy when Credit Plus sold merged infile credit reports to mortgage lenders. The reports at issue allegedly displayed a nonzero calculated monthly payment on certain charged-off accounts even though two of the three major credit bureaus reported a zero balance. The case is Cinner v. Xactus, LLC, No. 2:23-cv-04531-JMY, in the U.S. District Court for the Eastern District of Pennsylvania.
