If you used the Flo period- and ovulation-tracking app several years ago, you may be entitled to a share of a $59.5 million settlement fund — but you have to file a claim to get it. The deadline is October 15, 2026.
Here is who qualifies, what the case is about, and how to file.
What happened
The lawsuit, Frasco, et al. v. Flo Health Inc., et al. (No. 3:21-cv-00757, U.S. District Court for the Northern District of California), alleged that Flo Health allowed third parties — including Google, Meta, and the analytics firm Flurry — to eavesdrop on users’ confidential, in-app health communications without their consent, through software development kits (SDKs) embedded in the app.
After a jury found for the plaintiffs at trial, three defendants agreed to settle. Google agreed to pay $48 million, Flo agreed to pay $8 million, and Flurry agreed to pay $3.5 million — a combined $59.5 million settlement fund. The defendants deny wrongdoing.
Who is eligible
You are a member of the nationwide Class if:
- You used the Flo App in the United States between November 1, 2016 and February 28, 2019; and
- You entered menstruation and/or pregnancy information into the Flo App during that time.
A separate California Subclass covers people who used the app while living in California during that same period. Because of California’s data-protection laws, verified California Subclass members are eligible for a larger pro rata share of the fund than other claimants.
You are included only if you did not previously exclude yourself in connection with the June 2025 class notice.
What you can claim
Eligible class members who submit a valid claim receive a pro rata (proportional) cash payment from the net settlement fund — the exact amount depends on how many valid claims are filed. Payments are sent digitally (PayPal, Venmo, Apple Pay, direct deposit, or a mailed paper check on request).
California residents may also be eligible for an additional payment tied to a separate verdict against Meta arising from the same litigation; eligible claimants will be contacted later.
How to file before October 15
The fastest way to claim is online through the official settlement website. Paper claim forms can also be mailed, but must be postmarked no later than October 15, 2026. Online claims must be submitted by 11:59 p.m. Pacific Time on that date.
A Final Approval Hearing is scheduled for October 29, 2026. Be cautious of anyone who contacts you asking for a fee or payment to “process” your claim — filing is free through the official administrator.
